SOCIAL INCLUSIVITY AND ANTI-DISCRIMINATORY APPROACH FOR THE TRANSGENDER PERSONS IN INDIA: A LEGAL ANALYSIS
Abstract
The quest for equality and justice for transgender individuals in India has been a long and arduous journey. In a country with a rich cultural and historical legacy of diverse gender identities, the modern legal and social recognition of transgender rights has faced numerous challenges. However, recent judicial rulings and legislative reforms have marked significant progress.
Historically, transgender community in India was always recognized in various forms. It includes a variety of sub-groups like Hijras, Kothis, Aravanis, Jogtas, Shiv-shaktis, Eunuchs etc. Eunuchs, who have been documented since around the 9th century, were historically known for their role in safeguarding women's quarters in royal households. The term "eunuch" comes from Greek, meaning "keeper of the bed".
